Terms of service

These Terms of Service ("Terms") apply to your use of the Exclusive Gift House online store and to every purchase you make from us. "Exclusive Gift House", "we", "us" and "our" mean Exclusive Gift House of Lynn, Massachusetts. By using our store or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy and our Refund Policy. If you do not agree, please do not use the store.

1. Who can buy

You must be at least the age of majority where you live, or be using the store with the permission of a parent or guardian. We sell to customers who ship to addresses in the United States.

2. Orders

When you place an order, you will receive an email confirming that we received it. That email is not our acceptance of your order. We accept your order when we ship it. We may refuse or cancel an order, or limit quantities, for reasons such as an error in the product information or price, a suspected fraudulent or unauthorized purchase, or items that are no longer available. If we cancel an order after you have paid, we refund the full amount to your original payment method.

Our signature boxes are packed to order. If we cannot ship your order within the time we stated, we will tell you before that time passes and offer you a new ship date or the option to cancel for a full refund.

3. Prices and payment

Prices are in US dollars. Sales tax and shipping are calculated and shown at checkout before you pay. We may change prices at any time, but a change does not affect an order we have already accepted. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you. You agree to provide current, complete and accurate payment and contact information, and you authorize us and our payment providers to charge your chosen payment method for your order.

Corporate orders of 5 or more boxes are priced by written quote. The quote states the boxes, quantities, any volume pricing, shipping and taxes, and it governs that order together with these Terms.

4. Product information

We describe and photograph our products as accurately as we can, and each product page lists what is inside. Colors can look different on different screens. Each product page includes dietary and allergen notes, and full ingredient labels from each producer are inside the box. If you or your recipient have a serious allergy, please read the labels and contact us before ordering. Drinks in our boxes are non-alcoholic, 0.5% ABV or less. Please follow the safety label on every candle.

5. Gift messages

We write your gift message by hand on the note card in the box. We may decline to write a message that is abusive, unlawful or harmful, and we will contact you if we do.

6. E-gift cards

Exclusive Gift House E-Gift Cards are sold in $50, $100, $150, $250 and $500 amounts and are delivered by email. They do not expire. They can be used only in our online store and cannot be used to buy other gift cards. They are not redeemable for cash except where the law requires it. Anyone with the code can use the card, so keep it private. If you believe a code was used without your permission, contact us right away.

7. Shipping and risk of loss

We ship to US addresses only, as described in our Shipping Policy. Order-by dates and delivery estimates depend on the carrier. Title and risk of loss pass to you when we hand your order to the carrier. This does not limit the Make-It-Right Promise: if your box arrives damaged or incorrect, tell us within 7 days of delivery and we replace it or refund you. If a package is lost in transit or marked delivered but missing, contact us and we will open a claim with the carrier.

8. Returns and refunds

Returns and refunds are handled under our Refund Policy.

9. Accounts

If you create an account, you are responsible for keeping your login details private and for activity under your account. Tell us right away if you think someone has used your account without permission.

10. Acceptable use

You agree not to use the store for any unlawful purpose, to interfere with its security or operation, to copy or scrape its content in bulk, to submit false information, or to upload anything harmful, abusive or infringing.

11. Reviews and submissions

If you send us reviews, photos, ideas or other content, you confirm that it is yours to share and truthful, and you give us a non-exclusive, royalty-free license to use, display and reproduce it in connection with our store and marketing. We do not edit the meaning of reviews, and we remove only content that is unlawful, abusive, private or unrelated to the product.

12. Intellectual property

The store and its content, including text, photos, graphics, logos and the Exclusive Gift House name, belong to us or our licensors and are protected by law. You may not use them without our written permission.

13. Third-party services

Our store runs on Shopify, and payments are processed by third-party payment providers. Some items are made and shipped by independent makers. Links to other websites are provided for convenience, and we are not responsible for their content or practices.

14. Disclaimer

Except as stated in these Terms and in our policies, and to the extent the law allows, the store and our products are provided "as is" and "as available", without warranties of any kind, express or implied. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

15. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the store or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow these limits, so they may not apply to you.

16. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys' fees, that arise from your breach of these Terms or your misuse of the store.

17. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you and we consent to their jurisdiction. This does not take away any protection you have under the consumer laws of the state where you live.

18. Changes to these Terms

We may update these Terms from time to time. The version posted when you place an order applies to that order. We change the date at the top when we update them.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with our policies and any written corporate quote, are the entire agreement between you and us about your use of the store and your purchases.
